1. GENERAL

1. Fine Lines owns and operates the Website and the Products offered for sale on the Website are made available to You pursuant to these Terms and the Website Terms of Use.
2. These Terms apply to the ordering, purchase and delivery of Products from the Website.  Each time you place an Order, you agree to be bound by these Terms.
3. These Terms supersede any contrary terms of any invoice, order confirmation, delivery docket or other document issued by the Fine Lines to You.
4. We may change these Terms at any time. The Terms which apply at the time You place an Order are those which apply to that Order.

2. ORDERS

1. Orders must be placed in accordance with the Order and Delivery Policy.
2. You acknowledge that the representations of the Products on the Website do not constitute an offer to sell but an invitation to treat.  
3. By placing an Order, you make an offer to us to purchase the Products you have selected on the Website subject to these Terms.
4. You will receive an electronic Order confirmation from us as soon as practicable after you have placed your Order and made payment in full.
5. The electronic Order confirmation is an acknowledgement that we have received your Order and does not constitute the acceptance of the Order.  
6. An Order will be accepted, and an agreement between Fine Lines and You, will be formed once your payment has been received and approved, your debit or credit card has been debited via Shopify Payments, PayPal, AfterPay ZipPay and/or ZipMoney and any additional verification procedures (outlined in clause 5(2)) have been undertaken by us or a third party.
7. Once you have placed your Order, you cannot cancel or revoke your Order unless expressly provided for in these Terms. However, you can return Products under the Returns Policy.

3. STOCK AVAILABILITY

1. All Orders are subject to the availability of stock.  If your Order contains a Product that is subsequently out of stock or unavailable for any reason, we may not be able to fulfil all or part of your Order.  Accordingly, we will cancel all or part of the Order and refund any monies paid to us in accordance with clause 7(1).
2. We reserve the right to withdraw from sale any Products displayed on the Website for any reason and at any time.   If your Order contains a Product that has been withdrawn from sale and the payment for that Product has already been processed, we will cancel all or part of the Order and refund any monies paid to us in accordance with clause 7(1).  
3. We reserve the right to correct any errors in pricing, image or description of Products on the Website. If your Order is affected by an error in pricing, image or description of a Product, we will notify You of this as soon as possible.  For pricing errors (where your Order and payment has been approved, we will give You the option of either re-ordering the Product(s) at the correct Price or cancelling the Order and receiving a full refund. For image or description errors we will give you the option of continuing with the Order or cancelling the Order and receiving a full refund.

4. PRICE, OTHER FEES AND TAXES

1. You agree to pay the Price and a Delivery Fee (if applicable) when You place an Order.
2. The Products in your Order are charged at the Price specified on the Website at the time you place the Order.
3. Prices and Delivery Fees are in Australian dollars ($AUD) and include GST (where applicable).
4. Prices are subject to change at any time without notice to You.  Subject to clause 3(3), if you have placed an Order at a particular price, then we will supply the Product(s) at that Price.
5. For deliveries outside of Australia, You must pay any customs and import duties, value added tax and/or taxes that may be levied on your Order upon arrival at the country in which your nominated delivery address is located.  

1. Orders must be placed using an approved payment method.  The payment methods are specified on the Website and in the Ordering Policy.
2. We reserve the right to undertake, or engage a third party to undertake, fraud detection procedures to verify that the Order and credit card details are genuine and that You are the legitimate cardholder.
3. Your Order will not be processed or delivered if a payment has not been approved by us in accordance with clauses 2(6) and 5(2). 

6. DELIVERIES

1. Products are delivered in accordance with these Terms and the Order and Delivery Policy.
2. Fine Lines is not liable for any delays in the delivery of any Products to your nominated delivery address if such delay is caused by circumstances beyond the reasonable control of Fine Lines   its delivery agent or the postal operator.
3. Risk and title in the ordered Products pass to You upon delivery of the Products to your nominated delivery address.

7. ORDER CANCELLATIONS

1. We reserve the right at any time after the receipt of the Order to reject or cancel the Order for any reason including without limitation unavailability of stock; withdrawal of stock; an error in the price, image or description of the Product; an incorrect or incomplete Order; or unapproved payments. If we reject or cancel your order, we will immediately notify You by email or phone using the email address or number(s) provided by You.  If applicable, we will refund any payment made by You by using the original tender and method used by You to place the Order.
2. To the extent permitted by law, Fine Lines will not be liable to You for any loss or damage suffered by You or any third party as a consequence of the cancellation of an Order for any reason.  

8. RETURNS

1. Products must be returned in accordance with the Returns Policy.

9. PROMOTIONS

1. Fine Lines may from time to time promote or advertise competitions, trade promotions, events, offers and other promotional activities.  Certain offers are subject to terms and conditions which will be specified at the time of issue and on the Website.
2. Fine Lines may from time to time offer promotional or discount codes which may apply in respect of certain Products purchased via the Website.  The promotional or discount codes are personal to the customers to whom they are issued and cannot be transferred or sold to another person.  The conditions of using the promotional or discount code will be specified at the time of issue. We reserve the right to cancel all or any promotional or discount codes at any time if we suspect or detect errors, fraud or misuse of the codes.

10. LIMITATION OF LIABILITY

1. These Terms do not affect or limit your statutory rights.
2. Our Products come with guarantees that cannot be excluded under the Australian Consumer Law.  You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.  You are also entitled to have the Products repaired or replaced if the Products fail to be of acceptable quality and the failure does not amount to a major failure.
3. Other than those statutory rights that cannot be excluded, Fine Lines excludes to the maximum extent permitted by law, all implied term and warranties, whether statutory or otherwise, which relate to the subject matter of these Terms.
4. To the maximum extent permitted by law, Fine Lines, its officers, employees, agents and representatives will not be liable to You for any loss, damage, claim, injury, cost or expense (including any direct, indirect, special or consequential loss or damage), however caused which may arise directly or indirectly from or in connection with these Terms, except if such loss or damage arises as a result of our gross negligence.
5. To the extent permitted by law, Fine Lines is not liable for any delay in performing any of its obligations under these Terms if such delay is caused by circumstances beyond the reasonable control of Fine Lines.

11. INDEMNITY

• any breach of any obligation under these Terms by You; or
• any negligent or willful act or omission by You.

• at any time by giving notice to you pursuant to clause 14(1); or
• immediately without notice if You have breached these Terms and failed to remedy the breach within 7 days of being given notice by us to do so or if the breach cannot be remedied.

13. PRIVACY

1. Fine Lines will handle any personal information collected from You in accordance with the relevant privacy collection statement specified on the Website and the Privacy Policy.
2. We may send you direct marketing materials if you:

• signed up to our email subscriber program; or
• if you placed an Order via the Website, unless you indicated otherwise in your account profile or You opted out at the time you placed the Order.

14. GENERAL

1. We may notify You by email or phone using the email address or phone number(s) provided by You.  You may notify us by email at customerservice@simondewinter.com.au
2. If any clause of these Terms is invalid, illegal or unenforceable, it is to be read down or severed and the rest of the Terms remain in force.

15. APPLICABLE LAW AND JURISDICTION

1. These Terms are governed by and construed in accordance with the laws of Victoria, Australia.
2. Fine Lines and You submit to the exclusive jurisdiction of the courts of Victoria, Australia.

1. INTRODUCTION

• By submitting an entry into the Henne & Fine Lines Promotion (Promotion), entrants warrant that they have read, understand and agree to be bound by these terms and conditions, which apply to the Promotion (Terms & Conditions).
• The Promotion is conducted by Corvin Group Pty Ltd (ABN 28 658 225 364) ofNorth Carlton, Victoria 3054 customerservice@simondewinter.com.au / 03 93872100.
• The prizes are being provided by Henne Clothing Pty Ltd ABN 16 637 863 168 of 1/146 Burwood Rd, Hawthorn 3122 (Henne).

2. DURATION

The Promotion commences on 10th May 2023 at 8am AEDT and ends on 14^th May 2923 at 11.59pm AEDT (Promotion Period).

3. ELIGIBILITY

• Entry is open to individuals who are 18 years and older.
• Employees of the Promoter and their related bodies corporate, as well as the immediate families of those employees are ineligible to enter.
• Entrants warrant that they are entering the Promotion in a wholly private nature and are not entering on behalf of a business or enterprise activity they are involved in or on behalf of any other person.

4. METHOD OF ENTRY

• To enter the Promotion, entrants must purchase any full price items off the Fine Lines lingerie website (www.finelineslingerie.com.au) to the value of $100 per transaction (after the application of the MAY20 discount code) during the Promotional Period. This then provides for automatic entry into the Promotion.
• Those entrants who have not complied with the entry process in this clause 4 will be disqualified.
• Inaudible, incomplete, incomprehensible or late entries (whichever is applicable) will not be eligible and will be disqualified. The Promoter reserves the right to disqualify any entry which in the opinion of the Promoter includes any content which may be unlawful, profane, inflammatory, defamatory and/or damaging to the goodwill or reputation of the Promoter or Henne.
• Any person who is discovered to have used or attempted to use more than one name in entering the Promotion will be disqualified from participating in the Promotion and/or redeeming a prize.
• Unless otherwise stated in these Terms & Conditions, no person may enter this Promotion more than once.
• All entrants acknowledge that the Promoter may rely on this clause 4 even after the Promoter has awarded a prize to a person or after a person is announced as a prize winner. The Promoter reserves its rights to require return of the prize, or payment of its value, to the Promoter if this occurs.
• Should an entrant’s contact details change during the Promotion Period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify and information provided in an entry should be directed to the Promoter at its email address in clause 1.
• Entries submitted via SMS, email or other electronic means are deemed to be received at the time of receipt into the Promoter’s database not at the time of transmission by the entrant.
• The entrants acknowledge and agree that they are responsible for their own costs associated with accessing the Internet to enter the Promotion.

5. DETERMINING PRIZE WINNERS

• The prize winners will be determined by a prize draw conducted by the Promoter from all valid entries received during the Promotion Period. The first valid 5 entries randomly drawn will win the prizes.  The prize draw will take place at 660 Rathdowne Street, North Carlton, Victoria 3054 on 15^th May 2023 at 4pm AEDT.
• Subject to law and anything expressly permitted in the Terms & Conditions Schedule, in the event that the Promoter becomes aware that the same person has been selected as a prize winner more than once, the Promoter will cause another name to be drawn/selected in their place.
• Subject to law, if the Promoter has not been able to contact one or more prize winners despite every reasonable effort taken to contact the prize winner(s), such prize(s) will be deemed to have been forfeited by those prize winner(s) and a re-draw will take place to determine a new prize winner(s) on 29^th May 2023 at 5pm AEDT.

6. PRIZES

• The prizes are 5 x AUD$200 Henne Vouchers to be redeemed in store at the Henne Boutique, 122 Greville Street ,Prahran 3181 or online at henne.com.au.
• The total prize pool is $2,500.
• The prizes are non-transferable and non-exchangeable, and are not redeemable for cash unless cash is specified.
• As the prizes are in the form of vouchers, the prizes are subject to any conditions specified by Henne. The Promoter shall not be liable for any voucher that has been lost, stolen, forged, damaged or tampered with in any way.

7. NOTIFICATION

• The prize winners will be notified either via email or by telephone on 15^th May 2023 after 4pm AEDT by the Promoter and the prize winner will be announced on the Promoter’s website on 16^th May 2023.
• In the event of a prize re-draw, the prize winners will be notified either via email or by telephone on 31^st May 2023 by the Promoter and the prize winner will be announced on the Promoter’s website on 1^st June 2023.

8. PRIZE COLLECTION AND AVAILABILITY

• The Promoter will email or mail the prize(s) to the prize winner(s) at their nominated email or mailing address.
• The Promoter reserves the right to request each prize winner to provide proof of identity, proof of entry validity (i.e. proof of purchase) in order to claim the prize. Proof of identity, entry validity considered suitable for verification is at the Promoter’s discretion. In the event that a prize winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

9. TAXES

Any tax payable as a result of a prize being awarded or received will be the responsibility of each prize winner.  Prize winners should seek independent financial advice prior to accepting a prize if this is a concern. 

10. RELEASE AND INDEMNITY

To the extent permitted by law, all entrants release the Promoter from, and indemnify the Promoter against, all liability, cost, loss or expense arising out of participation in the Promotion and/or acceptance and use of any prize(s) including (but not limited to) loss of income, loss of opportunity, personal injury and damage to property, whether direct, indirect, special or consequential, foreseeable, due to some negligent act or omission or otherwise.

11. TAMPERING AND OTHER MATTERS

• If for any reason this Promotion is not capable of running as planned as a result of any (including but not limited to) technical failures, unauthorised intervention, computer virus, mobile phone failure, tampering, fraud or any other causes beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right (subject to law) to cancel, terminate, modify or suspend the Promotion and/or any draw/s and/or disqualify any individual who (whether directly or indirectly) causes the same.
• The Promoter accepts no responsibility for any late, lost or misdirected entries including but not limited to electronic messages not received by the Promoter due to technical disruptions, network congestion or other reasons.

• The Promotion is being operated and promoted via Instagram.

13. TERMINATION OF PROMOTION

14. DECISIONS FINAL

All decisions and actions of the Promoter relating to the Promotion and/or redemption of the prizes are at its absolute discretion and are final.  No discussions or correspondence with entrants or any other person will be entered into.

15. PERSONAL INFORMATION AND PRIVACY

• The personal information supplied by entrants when entering this Promotion will be used by the Promoter for the purposes of conducting this Promotion; communicating with the entrants about the Promotion and awarding the prizes to the prize winners.
